Sub:    Refusal to Furnish MBBS Degree Certificate of Dr. Bhavana Kishor Satwick, former Student of MIMER Medical College during the period from 2013 to 2019

 

Ref:     My various letter/requests culminating to last communication dated 27/11/2020 on the captioned subject.

 

I, Shri. Kishor Vasant Satwick, father of Dr. Bhavana Kishor Satwick do hereby address the following Notice to you as follows:

 

1.         That, you all are the Trustees of a Public Trust viz. Maharashtra Academy of Engineering and Education Research (MAEER) which runs a Medical College in the name of Maharashtra Institute of Medical Education and Research (MIMER) Medical College, at Talegaon-Dabhade, District Pune.

 

2.         That, my daughter, Dr. Bhavana Kishor Satwick had secured admission for MBBS Degree Course of MIMER Medical College for the Academic Year 2013 – 2014 to Academic Year 2018 – 2019.  That, during her entire course my daughter has been an excellent and outstanding student of MIMER Medical College having excellent academic record and she has won many prizes at Inter Collegiate Quiz Competition in Maharashtra and has also been awarded various Certificates of excellence and merit and has also been awarded Gold/Silver Medals for securing first or second rank in various subjects.  I say that her name has also been written on the Merit List for some subjects for her batch.  That, my daughter completed her MBBS Degree Course in the year 2017 and successfully her Internship from February 2018 to March 2019 out of which the first 2 months of Internship were at MIMER and the remaining 10 months were completed from Seth G.S. Medical College (K.E.M. Hospital, Mumbai) and accordingly she has successfully completed the MBBS Degree Course in March 2019.

 

3.         That, in the meantime in January, 2019 my daughter had appeared in NEET-PG and she secured admission to M.S. (General Surgery), MGIMS, Sevagram, Dist. Wardha and her Academic Year has started from 2nd May 2019 and since then she is residing at Sevagram, Dist. Wardha.

 

4.         That, as per the practice, the Maharashtra University of Health Science, Nashik (MUHS) had sent the Degree Certificates of all the students of MIMER to MIMER Medical College in or about July, 2019, to be handed over to the respective students, on behalf of the MUHS.  Since my daughter was continuing her M.S. Course in Wardha she was unable to visit the MIMER Medical College to collect her MBBS Degree Certificate and hence she had authorized me to collect the Degree Certificate from the College.  Needless to mention that Wardha is at a distance of around 700 Kms from Pune and hence travelling from Wardha is also not convenient.  Accordingly, my daughter had sent an E-mail and letter addressed to the Principal, MIMER, thereby informing the Principal that she had authorized me to collect the MBBS Certificate on her behalf.

 

5.         That, my daughter had sent an E-mail to the Principal Dr. Rajendra Prasad Gupta on 19th August, 2019 and had also sent a scanned copy of the said letter as email attachment to the learned Principal thereby requesting him to hand over the Degree Certificate to me.  A copy of the said authority letter and the email is attached herewith for ready reference.

 

6.         That, in spite of the authority letter, the Principal refused to hand over the Degree Certificate to me. I therefore decided to approach Dr. Suchitra Nagare, Executive Director of MIMER Medical College for the redressal of grievance and accordingly sent an email to Dr. (Mrs.) Suchintra Nagare on 21st August, 2019 requesting her to look into the matter and hand over the Degree Certificate to me as soon as possible.  Accordingly, she had promised that she would look into the issue and that the Principal’s Office would get in touch with me.

 

7.         That, instead of handing over the Degree Certificate to me, to my utter shock and surprise, I received an email on 22nd August, 2019 from the Principal Dr. Rajendra Gupta stating therein and which I hereby quote “as per Institution Rules, candidate has to collect MBBS Degree Certificate personally.  Hence it is advised to send your ward for collection of Degree Certificate.”

 

8.         Immediately, thereafter, on the same day I had sent a Reply vide email to Dr. Gupta requesting him to specify the Rules according to which the Degree Certificates were supposed to be collected by the candidates himself/herself and no one else.

 

9.         That thereafter, Dr. Gupta wrote to me on 26th August, 2019 thereby informing that “as per Institutional Rules and Strict Guidelines by Maharashtra University of Health Science, Nashik, the Institute shall distribute the Decree Certificates to the concerned students” and he further instructed me to visit the MUHS Website for further details.  Thereafter, I immediately checked the MUHS Website and I could not find any such Rule as quoted and relied upon by the Principal Dr. Gupta. I therefore called the Offices of MUHS Registrar and MUHS Controller of Examination to find out about the Rules as stated and relied upon by Dr. Gupta.  I was informed by one Mr. Borse and Mr. Kokate for and on behalf of MUHS that there was no such Rule by the MUHS and in fact both of them were surprised at the behaviour of MIMER and its Authorities to withhold the MBBS Degree Certificate of my daughter. They also further informed me that even MUHS hands over Certificates directly to a person other than the student who has been nominated/authorised in writing by such student to collect the Certificates.  Accordingly, by email dated 26th August, 2019 I brought this information to the notice of Principal Dr. Gupta and hoped for a favourable reply and for delivery of the MBBS Certificate of my daughter. However, Dr. Gupta failed to respond to my email or to hand over the Degree Certificate.  Finally, I sent a reminder on 31st August, 2019 to Principal Dr. Gupta and to the Executive Director Dr. (Mrs.) Suchitra Nagare. However, there was no response from both of them. 

 

10.      That thereafter, on 13th September, 2019 I again sent a reminder to both, Principal Dr. Gupta and the Executive Director Dr. (Mrs.) Suchitra Nagare bringing the above facts to their notice and requesting them to hand over the Degree Certificate of my daughter.  However, there was no response from either of them.

 

11.      Finally, on 24th September, 2019 my daughter Dr. Bhavana Kishor Satwick, again sent another written request to the Principal Dr. Gupta and the Executive Director Dr. (Mrs). Suchitra Nagare to hand over the MBBS Degree Certificate to me. However, there was no response yet again.  Thereafter, I had sent an email on 10th October, 2019 to the Managing Trustee, Dr. Vishwanath Karad and brought to his notice the above illegal activities carried out by the staff.  However, there was no response from him either.

 

12.      That thereafter, I sent two reminders on 14th November, 2019 and 18th November, 2019 to the Executive Director, Dr. (Mrs.) Suchitra Nagare. However, there was no response to my several emails.

 

13.      That meanwhile, on 11th December, 2019 at about 12.25pm I managed to meet Dr. Vishwanath Karad, the Managing Trustee. The meeting was an exercise in futility as I found Dr. Vishwanath Karad had already made up his mind.

 

When I tried to explain him the facts, he flatly refused to even hear me on facts. He started accusing me of making an ego issue. He even advised me how my daughter can travel from Nagpur to Pune overnight to collect degree certificate personally and go back by return overnight train to Nagpur. [All this was coming from a person who himself never went to Mumbai for verification of income tax appeals, writ petitions, affidavits in reply, etc. filed by MAEER before Prothonotary of Bombay High Court and instead signed them before a Notary in Pune, and that too in his own office at MAEER. I am sure even he would agree with me that Pune Mumbai distance is much shorter than Nagpur Pune via Mumbai and he should have travelled regardless of his busy schedule as he expects my daughter to do. Prof. Dr. Vishwanath Karad also seems to be unaware of the tremendous patient load in Government Hospitals unlike some hospitals run by private colleges where Resident Doctors are most of the time busy preparing records of dummy patients to meet MCI requirements either for retaining the recognition or applying for increase in seats.]

 

When I again politely tried to bring the basics of the issue, he just told me that since he is a professor, he knows more than me and doesn’t want to hear anything. He advised me to tell my daughter that this College hands over certificate only to the student and she should come personally or this would ruin her.

 

Meanwhile, he talked to his daughter Dr. Suchitra Nagare on phone. He asked her whether there is any law that prohibits delivery of degree certificate to parents of student. After his telecon with his daughter his arrogance burst viciously. He again repeated his allegation that I am making it an ego issue and asked me to get out of his chamber immediately.

 

This conduct on the part of one of the Founding Trustees is a testimony that how the bloated egos of Trustees at MAEER are flying sky high. It is evident that there is no law that prohibits delivery of degree certificate to the parents of the student particularly when the student has made written request to that effect. When the Managing Trustee Prof. Dr. Vishwanath Karad himself is so arbitrary – to say the least, in his conduct towards me and the issue, can one expect anything else from his daughter Turstee Dr. Suchitra Nagare and Principal Dr. R P Gupta?

 

14.      That thereafter, by a letter dated 16th December, 2019 I had addressed to all the Trustees of MAEER Trust bringing to their notice the illegal acts carried out by the Office Bearers of MIMER Medical College. However, there has been no reply from any of the Trustees and hence I was constrained to send another Notice dated 27th November, 2020 to all the trustees of MAEER highlighting that the MBBS Degree Certificate is a valuable property belonging to my daughter and which she is legally and rightfully entitled to receive. That MUHS has sent the degree certificates to MIMER Medical College as their agent to deliver the certificates to all its students or their nominated/authorized representatives. MIMER Medical College has no right over such Degree Certificates and it cannot legally withhold such certificates. That, it is not disputed that my daughter Dr. Bhavana Kishor Satwick never sent any written request and authorization to MIMER Medical College in this regard. That all of you in connivance with each other are withholding the valuable property of my daughter for reasons best known to you. That the above acts of withholding my daughters MBBS Degree Certificate on the part of MIMER, the Principal Dr. Gupta and Dr. Mrs. Suchitra Nagare, amount to illegal acts for withholding/confiscating valuable property of my daughter and the same also amounts to harassment of criminal nature and criminal breach of trust.

 

15.      I have received a copy of reply dated 20th January, 2021 from Advocate Avinash B Avhad, the Trustee of MAEER addressed to the Board of Trustees, MAEER. You have also received the said reply. Advocate Avinash B Avhad, the Trustee, MAEER has clearly expressed his shock to the arbitrary and mala fide conduct of the Principal of MIMER Medical College with the tacit support of other Trustees in continuing the present misdemeanour of denying my daughter her fundamental right to receive her degree certificate and nominate her family member to receive the same on her behalf. He has also requested you to handover the degree certificate of my daughter to me as per her written request without any further delay. However, unfortunately you have chosen to neglect his advice too. Copy of the said reply is appended hereto for your ready reference.

 

 


 

 

16.      I once again narrate the undisputed facts for the sake of brevity and easy reference to you:

 

1)  MUHS has no such rule as falsely claimed by Principal Dr. R P Gupta and subsequently defended by Dr. Suchitra Nagare and Prof. Dr. Vishwanath Karad.

2)  Principal lied that MUHS Rule makes it compulsory to hand over the degree certificate only to the student.

3)  It is not denied that my daughter never sent any written request to this effect.

4)  It is not denied that College has never acted upon written requests of my daughter in the past – till March 2019 to hand over Internship Completion Certificate, Bona fide certificate, etc.

5)  MIMER Medical College had no lawful, logical and palatable reason to insist on student to personally come to collect it when she has a fundamental right to nominate her father or any other blood relative to collect the same on her behalf without assigning any reason for that matter.

 

17.      You have also ignored the advice of wisdom from your fellow Trustee Advocate Avinash B Avhad that your action is not only patently illegal but also constitute an outright criminal act. Considering the facts and the circumstances, the present misdemeanour of Principal Dr. R P Gupta is fully backed by the Trustees from Karad Family and Ghaisas Family without any exception.

 

18.      I therefore once again call on you by giving you this final notice to kindly arrange to handover the MBBS degree certificate of my daughter Dr. Bhavana Kishor Satwick to me as per her specific written request communicated to the Principal, MIMER Medical College within a period of 10 days from the receipt of this Notice, failing which, I would be constrained –

 

a.  to bring this misdemeanour and criminality to the notice of the concerned authorities including the media and

b.  to file Criminal and/or Civil proceedings against you at your risk as to the cost and consequences thereof which you please note.
